Prosecution appeals ruling favoring defense

LAKE COUNTY, Ill. (AP) — An appeal means there will be another delay in the trial of the wife of a northern Illinois police lieutenant who killed himself and made it look like it was a line-of-duty death.

Wednesday, prosecutors asked a state appellate court to overturn a judge’s decision that marital privilege protects text messages they hoped to use in their theft case against Melodie Gliniewicz.

Last month, a judge ruled the text messages between Gliniewicz and her late husband, Fox Lake Police Lt. Joe Gliniewicz, can’t be used at trial. A defense attorney didn’t comment after Wednesday’s brief court hearing.

Melodie Gliniewicz was indicted after her husband committed suicide in September 2015. She has pleaded not guilty to charges including siphoning money from a youth policing program.
